Projekt Agency Pty Ltd ACN 675 745 614 trading as ComplyIQ (we, us and our) is a provider of AML/CTF compliance software solutions (Software) for licensed gaming venues (Venues). Please read these terms carefully before accessing or using the ComplyIQ platform.

Acceptance of Terms

Where a venue has entered into a signed ComplyIQ SaaS Agreement, that agreement governs its use of the platform and prevails over these Terms of Use to the extent of any inconsistency.

By accessing or using the ComplyIQ website and software, you agree to be bound by these Terms of Use and our Acceptable Use Policy. If you are using this on behalf of a Venue (the “Licensee”), you represent that you have the authority to bind that entity to these terms.

No Professional Advice

ComplyIQ provides a software platform to assist with AML/CTF record-keeping. We are not a law firm or an AML/CTF consultancy. Use of ComplyIQ does not guarantee compliance with the AML/CTF Act 2006.

The Licensee remains solely responsible for its own regulatory obligations, including the accuracy of all reports submitted to AUSTRAC.

Acceptable Use Policy (AUP)

You agree not to use ComplyIQ to:

  • intentionally hide, structure or obfuscate transactions to avoid AUSTRAC reporting thresholds;
  • reverse engineer, scrape or data mine the platform in any form;
  • share your login credentials with unauthorised third parties, or use another staff member’s MFA token;
  • conduct penetration testing or vulnerability scans without ComplyIQ’s prior written consent;
  • upload data that is fraudulent, defamatory, or that infringes the privacy or other rights of a third party; or
  • use identity verification results to profile or track a person, for marketing, to offer or advertise goods or services, or for market research.

Account Security

You are responsible for maintaining the confidentiality of your login credentials. ComplyIQ requires Multi-Factor Authentication (MFA) for all compliance-level roles. Any activity occurring under your account is your responsibility.

Intellectual Property

All content, UI/UX designs, “SMR Wizards,” and proprietary algorithms are the sole property of ComplyIQ. You are granted a limited, non-transferable licence to use the software for the duration of your paid subscription.

Termination of Use

We reserve the right to suspend or terminate your access immediately, without notice, if we reasonably believe you have breached this Acceptable Use Policy or are using the platform for fraudulent purposes.

Limitation of Liability

To the maximum extent permitted by Australian Consumer Law, ComplyIQ’s liability for any breach of these terms is limited to the resupply of services or the cost of the subscription for the preceding 12-month period.

This limitation applies to all claims, whether in contract, tort, or otherwise, to the fullest extent permitted under applicable Australian law.
